Validity of Terms of Sale

  1. The terms of sale apply to purchases of goods and services between the buyer (hereinafter Consumer) and the company Vinkymon OÜ (hereinafter Online Store vinkymon.ee) on the website vinkymon.ee.
  2. The owner of the online store vinkymon.ee is Vinkymon OÜ.

  3. In addition to these terms, legal relations arising from purchases in the vinkymon.ee online store are regulated by the Law of Obligations Act (hereinafter LOA), the Consumer Protection Act (hereinafter CPA), and other applicable laws in the Republic of Estonia.
  4. The online store vinkymon.ee reserves the right to amend the terms of sale. Such amendments will be reflected on the website vinkymon.ee.

Pricing Information

  1. The prices of the products sold in the online store are indicated next to the products.
  2. All prices listed on vinkymon.ee include a 22% VAT.
  3. The total purchase price includes the shipping fee based on the delivery method chosen by the Consumer.
  4. The delivery fee depends on the Consumer’s location and the chosen delivery method. The delivery fee is displayed to the buyer at checkout.
  5. Information about the products is provided directly next to the products in the online store.
  6. If an order is placed before changes to the terms of sale or prices, the terms applicable at the time of ordering shall apply to the legal relationship between the Consumer and the Online Store.
  7. The online store reserves the right to make changes to prices. These changes will be reflected on the website vinkymon.ee.

Placing an Order

  1. To order a product, add the desired items to the shopping cart.
  2. To proceed with checkout, first click on “Add to cart” in the shopping cart.
  3. Next, select “Proceed to checkout.”
  4. On the checkout page, fill in the required fields, choose a delivery method, and click “Proceed to payment.” You can enter a discount code on the same page. An invoice will be displayed on the screen, which you can conveniently pay via bank links (Swedbank, SEB, LHV, Coop, Luminor). Payment details, including all applicable state taxes and additional fees, will be displayed on the invoice after order confirmation. The responsible data processor is Vinkymon OÜ. Vinkymon OÜ forwards the necessary personal data for payment processing to the authorized processor Montonio Finance UAB.
  5. Please fill in all required fields carefully, as the accuracy of the provided information affects the timely and smooth delivery of your order and any potential dispute resolution.
  6. Check the box “I agree with the general and refund terms.”
  7. Orders placed in the online store are processed on business days between 10:00-16:00. If an order is placed on a Friday after 12:00, processing may take place on the next business day.
  8. The average shipping time for vinkymon.ee is 1-3 business days, depending on the chosen delivery method.

Conclusion of Sales Contract

  1. By concluding a sales contract, the Online Store is obliged to transfer the existing, manufactured, or acquired goods to the Consumer and enable the transfer of ownership. The Consumer is obliged to pay the amount specified in the invoice and accept the goods.
  2. Orders that are not paid for will be canceled after 7 days from the order date.
  3.  The sales contract enters into force after the Consumer’s payment is received in the Online Store’s bank account.

Delivery

  1. After the sales contract has come into effect, the Online Store will assemble the order and hand it over to the company’s logistics partners for delivery. It is no longer possible to cancel an already processed order.
  2. The delivery times displayed on the vinkymon.ee website apply from the moment the payment is received in the Online Store’s bank account. The average delivery time is 1-3 business days.
  3. To ensure timely delivery, the Consumer must carefully enter accurate and valid shipping details when placing an order. If the product has not arrived within a reasonable time, the Consumer should contact info@ebakudoonia.ee to verify the accuracy of the recipient’s details. If an order is returned to the Online Store by the logistics partner due to an incorrect address, the amount will be refunded to the Consumer within 7 business days from the date of the returned order’s delivery.
  4. The Online Store is not responsible for delivery delays if the order has been handed over to the logistics partner on time but is delayed due to circumstances beyond the Online Store’s control or foreseeability.

Right of Withdrawal

  1. The Consumer has the right to withdraw from the contract without providing a reason within 14 days of receiving the order. To return an item, the Consumer must submit a withdrawal request, which can be found here, and send it via email to info@ebakudoonia.ee within 14 days of receiving the goods.
  2. The returned item must be unopened, undamaged, unused, and in its original packaging.
  3. The buyer bears the cost of returning the item.
  4. The Consumer must return the item within 14 days of submitting the withdrawal request or provide proof that the item was handed over to a delivery service within that period.
  5. The 14-day right of return does not apply to items in sealed packaging that are not suitable for return due to health or hygiene reasons and have been opened after delivery (e.g., soft drinks, syrups, sweets, chips, wines).
  6. If the Consumer has expressly chosen a delivery method other than the least expensive standard delivery method offered by the Online Store, the Online Store is not obliged to reimburse the Consumer for costs exceeding the standard delivery cost.
  7. Upon receiving the returned product, the Online Store will promptly refund the Consumer all payments made under the contract, but no later than 14 days from the date of receipt of the withdrawal request. The Online Store may withhold the refund until it has received the returned item or until the Consumer provides proof that the item has been returned, whichever occurs first.
  8. The Online Store has the right to withdraw from the sales transaction and demand the return of the item if the price of the product was significantly lower than its market value due to an error.
  9. If the Consumer receives the wrong product or if the product is damaged during transportation, they must contact info@ebakudoonia.ee.

Force Majeure

  1. The Online Store is not responsible for damages caused to the Consumer or for delivery delays if the delay is due to circumstances beyond the Online Store’s control or foreseeability.

Processing of Personal Data

  1. The Online Store is the data controller of personal information.
  2. The Online Store forwards necessary personal data for payment processing to the authorized processor Montonio Finance UAB.
  3. By entering their data in the online store and confirming their consent, the Consumer grants the right to collect and process personal data (name, contact phone, delivery and/or home address, email address) and to forward necessary personal data to the logistics partner for delivery.
  4. The Online Store has the right to use the Consumer's residential or location address for advertising and informational purposes.
  5. Electronic personal data processing for direct marketing will only occur if the Consumer has given separate consent for this.
  6. Encrypted communication with banks ensures the security of the Consumer's banking details, and the Online Store does not have access to this information.

Right to File Complaints

  1. The Online Store is responsible for any non-conformity or defect in the sold goods that existed at the time of delivery and becomes apparent within two years from the date of delivery to the buyer. If a defect appears within the first year, it is presumed to have existed at the time of delivery. The burden of proving otherwise lies with the Online Store.
  2. If a defect occurs, the buyer must contact the Online Store within two months by emailing info@ebakudoonia.ee or calling +372 53444844, +372 53420074.
  3. The Online Store is not responsible for defects that appear after the product has been handed over to the Consumer due to improper use, accidents, or natural wear and tear.
  4. If a product purchased from the Online Store has a defect for which the Online Store is responsible, it will be repaired or replaced.
  5. If the product cannot be repaired or replaced, the Online Store will refund the Consumer all associated costs.
  6. The Online Store will respond to Consumer complaints in writing or in a durable medium within 15 days.

Dispute Resolution

  1. If the Consumer has any complaints regarding the Online Store, they should be sent via email to info@ebakudoonia.ee or by calling +372 53444844, +372 53420074.
  2. If the Consumer and the Online Store are unable to resolve the dispute through mutual agreement, if the Online Store refuses to address the Consumer’s complaint, or if the Consumer is not satisfied with the proposed solution and believes that their rights have been violated or their interests harmed, the Consumer may submit a complaint to the Consumer Disputes Committee through the Consumer Protection and Technical Regulatory Authority or take the matter to court.
  3. The Consumer may also turn to the European Union’s online dispute resolution platform. For issues arising within EU member states, the Consumer can seek assistance from the European Consumer Centre or submit a complaint via the EU Online Dispute Resolution platform.
  4. The Consumer may submit a complaint personally or through a representative.
